WARRANTY  JANUARY 2011

Eco Block Distribution Pty Ltd warrants its products (“Eco Block Products”) against defects in material and workmanship. But Eco Block’s liability for Eco Block Products is limited to, in its sole discretion, refunding the entire purchase price without interest or repairing the defective product FOB its nearest plant (but does not include dismantling and installing such materials) so long as:

The Eco Block Product was purchased from an authorized Eco Block Agent;

1. Defects have arisen solely from faulty materials or workmanship;

2. The Eco Block Products have not received maltreatment, inattention or interference;

3. The Eco Block Products have not been damaged in transit after dispatch;

4. The Eco Block Products are properly installed in accordance with the Eco Block installation guide (available at http://www.ecoblock.net.au) as well as applicable building codes and standards in the State or Territory where the dispatch is received;

5. The failure of the Eco Block Product is a result of the manufacturer’s defect in workmanship or materials and is not the result of improper installation, repair, alteration or modification to the Eco Block product nor as a result of defects in the surface covering including waterproofing membranes;

6. Eco Block has an opportunity to inspect and test the structure; and

7. The claim under this limited warranty is made in writing to Eco Block within 1 calendar year of the dispatch of the Eco Block Product and within 30 days of discovery of the defect and is delivered to 121 Ingram Rd, Acacia Ridge, Queensland 4108 within those periods.

Except as provided herein all express and implied warranties, guarantees and conditions under statute or general law as to merchantability, description, quality, suitability or fitness of the Eco Block Products for any purpose or as to design, assembly, installation, materials or workmanship or otherwise, are expressly excluded but only to the extent permitted by law. The remedies provided by this limited warranty are the sole and exclusive remedies and Eco Block shall not be liable for any consequential loss or damage whether physical or financial of any kind arising out of the supply and use of the Eco Block Product.
